1. Smartphone Screen Protection Plan (“PLAN”)
Smartphone Screen Protection Plan is offered by Solvy Tech Solutions Private Limited (“Zopper”) which governs the support process for screen damage of Android Smartphones and iPhones. It is a monthly plan specifically designed to cater to device repair requirements at a very cost-effective price.
2. Plan Term
The Plan is valid for 30 days from the date of purchase. However, there is an initial waiting period of 7 days during which claims will not be allowed.
3. Plan Eligibility
Smartphone Screen Protection Plan can be bought anytime and covers all Android Smartphones and iPhones, up to 3 years old, irrespective of brand.
4. Scope of Service under the Plan
4.1 Inclusions (What is Covered):-
● The ambit of this cover is to guarantee repair of the smartphone screen throughout the coverage period in case of any damage to the screen
● Additional Benefits
○ The repairs will be carried out only by Authorized Service Centers.
○ Only genuine spare parts will be used while repairing the covered devices.
○ Customers get the screen covered up till the benefits value, as illustrated above, during the repair process
4.2 Exclusions (What is Not Covered):-
a) The device enrolled in the plan post the breakage of the screen
b) Any cosmetic item(s) including but not limited to buttons, plastic or metal casing etc.
c) Any damage due to normal wear and tear, moths, insects, vermin, mildew, inherent defect or any other gradually operating cause of the item(s).
d) Any loss or damage caused by or arising out of the willful acts or omission or gross negligence of the Customer /Customer’s family and/or employees of the Customer.
e) Any other damage to the smartphone apart from the screen
5. Transfer of the Plan
The transfer of ownership of the Plan from the Customer to another party will render the Plan & its benefits null and void. The plan will also be void in case of a change of ownership of the device.
6. General Terms
a) The Parties may subcontract or assign the performance of its obligations to third parties but shall not be relieved of its obligations.
b) The Parties is not responsible for any failures or delays in performing under the Plan that are due to events outside its reasonable control.
c) This Plan is offered and valid only if you are making a purchase in India and using in India.
d) This Plan is not offered to persons who have not reached the age of majority. This Plan may not be available in all states, and is not available where prohibited by law.
e) In carrying out its obligations, the Parties may, at their discretion and solely for the purposes of monitoring the quality of their response, record part or all of the calls between you and them.
f) The Parties have security measures, which should protect Customer’s data against unauthorized access or disclosure as well as unlawful destruction. The Parties will be responsible for the instructions which the Customer give to the Parties regarding the processing of data, and the Parties will seek to comply with those instructions as reasonably necessary for the performance of the service and support obligations under the Plan.
g) The Parties are not obligated to renew this Plan.
h) In the event any section or portion of a section of these terms and conditions are deemed invalid, void or unenforceable, that section or portion of a section shall be severed from these terms and conditions, and the remaining terms and conditions shall continue in full force and effect.
i) These terms and conditions shall be governed by and construed under the laws of India.
j) These terms and conditions do not affect your statutory rights as a consumer.
k) The Parties reserves the right, at its discretion, to change or modify the terms of this Plan.
l) Zopper will make all efforts to repair the device but in scenarios where the Authorized Service Center informs that the device can’t be repaired, then no further claim is admissible, and the consumer will be duly informed about it.
m) TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAYTM, ZOPPER AND ITS EMPLOYEES AND AGENTS WILL UNDER NO CIRCUMSTANCES BE LIABLE TO YOU OR ANY SUBSEQUENT OWNER FOR ANY INDIRECT OR CONSEQUENTIAL DEFECTS OR DAMAGES, ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICES, WHETHER FORESEEABLE OR UNFORESEEABLE, AND WHETHER BASED ON, BREACH OF CONTRACT, STRICT LIABILITY IN TORT, OR OTHER CAUSE OF ACTION INCLUDING BUT NOT LIMITED TO COSTS OF RECOVERING, REPROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA OR THE FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA, ANY LOSS OF BUSINESS, PROFITS, REVENUE OR ANTICIPATED SAVINGS, RESULTING FROM ZOPPER’S OBLIGATIONS UNDER THIS PLAN. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LIMIT OF PAYTM, ZOPPER AND ITS EMPLOYEES AND AGENT’S LIABILITY TO YOU AND ANY SUBSEQUENT OWNER ARISING UNDER THE PLAN SHALL NOT EXCEED THE VALUE OF PRODUCT. THE PARTIES SPECIFICALLY DOES NOT WARRANT THAT (i) IT WILL BE ABLE TO REPAIR OR REPLACE REGISTERED PRODUCT WITHOUT RISK TO OR LOSS OF PROGRAMS OR DATA, (ii) THAT THE OPERATION OF THE PRODUCT WILL BE UNINTERRUPTED OR ERROR-FREE.
7. CLAIM PROCESS
If any device or appliance has malfunctioned or suffered a breakdown, the customer needs to do the following:
● Customer needs to contact Zopper via Zopper’s dedicated helpline number 1800 103 7445 or email to assure@zopper.com to initiate a claim and inform about the breakdown.
● The customer may also be required to send across photos of the damaged device verifying the IMEI number of the covered device as instructed by the Zopper Team.
● Zopper Service team shall organize for a pick-up of the device from the customer location, based on the customer’s device, and get it repaired via a brand-authorized service center. Post-repairs, the said device is dropped back at the customer’s location.
● Zopper representative will contact the customer in case any payment for spare parts needs to be made by the customer.
The sole discretion on methods employed to ascertain the veracity of a claim rests solely with Zopper. In case any discrepancy is discovered regarding the claim made by the customer, Zopper reserves the right to cancel the claim and void the plan in question.
8. CANCELLATION AND REFUND
No cancellation is allowed under this plan and hence no refunds are applicable under this plan.
