1. Mobile Assure Extended Warranty Plan (âPLANâ)
Mobile Assure Extended Warranty Plan is offered by Solvy Tech Solutions Private Limited (âZopperâ), which governs the support process for breakdown on any Mobile. It is a monthly plan specifically designed to cater to device repair requirements. Mobile Assure Extended Warranty Plan replicates and extends the manufacturerâs warranty. If a covered mobile suffers a malfunction, Zopper will bear all the fixed costs of repairs as per the program.
This is an optional plan and is being provided with the consent of the customer. The customer hereby acknowledges having consented to the Plan and unconditionally gives its consent for using the data provided by it to be used for providing the Plan benefits to the customer.
Zopper accepts all responsibility and liability for any claims or disputes, including those from third parties, that may arise with the Mobile Assure Extended Warranty Plan. Zopper further confirms, represents and acknowledges that One97 Communications Limited (âOne 97â), along with its employees, directors and officers, expressly disclaims any and shall have no responsibility or liability whatsoever for any claims or disputes, including those from third parties, that may arise concerning Mobile Assure Extended Warranty Plan.
2. Mobile Assure Extended Warranty Plan Term
The plan's validity is either 30 or 90 days from the date of purchase, depending on the type of plan selected.
a) The coverage provided by the Mobile Assure Extended Warranty Plan begins after the expiration of the manufacturer's warranty. Therefore, if the mobile phone is still under the manufacturer's warranty, Zopper will assist in the repair process by facilitating pick-up and drop-off services to service centres. However, these repairs will be conducted according to the manufacturer's terms and conditions.
b) If the manufacturer's warranty is inactive, Zopper will assist with the Mobile Assure Extended Warranty Plan. This plan becomes effective from the date of its purchase and remains valid according to the selected plan option.
3. Plan Eligibility.
a) The customer should be 18 years of age.
b) The customer should be the rightful owner of the device.
The plan only applies to items purchased as new. Coverage is not provided for items described as âusedâ, âsecond handâ, or ârefurbishedâ. To qualify as 'new', the mobile phone should not have undergone any change in ownership from the time of its original purchase.
4. Scope of Service (Under the Plan)
a) Extended Warranty covers the cost of spare parts, labour and cost of transporting the covered product for repairs to the authorized service centre.
b) If the manufacturer warranty is active during the purchase of the plan, the customer will be provided with in-warranty support.
Exclusions:
1. Coverage does not apply to claims arising during the manufacturerâs warranty period.
2. Damage caused by unauthorized modification, alteration, adjustment, repair, service or installation by unauthorised personnel.
3. No coverage for products purchased or used for commercial purposes.
4. Loss, damage, or replacement of any accessory or consumable item, such as batteries, bulbs, plugs, cables, ribbons, belts, tapes, fuses, filters, toner, software, etc.
5. Defect due to normal wear and tear.
6. Routine maintenance, cleaning, lubrication, adjustments or alignments, overhaul, modifications.
7. Repair of the product due to accident, misuse, abuse, neglect, or improper maintenance.
8. Damage resulting from the power outage, power surges or drips, fluctuating voltage, inadequate or improper voltage or current, as well as mechanical or electrical breakdown caused by overloading, strain, overrunning, freezing, excessive pressure, short-circuiting, and heating.
9. Damage or failure occurs before or during transportation or due to improper storage, including the cost of transporting the insured asset to and from the repair facility.
10. Service of product on which the manufacturerâs label or logo, rating label or serial number have been defaced or removed.
11. No cover for consequential losses/legal liability of any kind.
12. Loss or damage arising out of any external cause, including but not limited to fire, theft, explosion, water damage, acts of God perils, riots/strike/malicious damage, - acts of terrorism, corrosion, rust, denting, scratching, animal/insect damage, entry of foreign bodies etc.
13. Loss or damage resulting from the insured asset not being used according to the manufacturerâs instructions/guidelines or due to improper use.
14. Loss or damage for which the manufacturer of the Insured Asset is responsible under a guarantee and/or warranty/conditions.
15. Inconsequential aspects such as noises, vibrations, warpage, oil seepage and sensations do not lead to the dismal performance of the Insured Asset.
16. Loss or damage caused by or arising out of the willful acts or willful gross negligence or fraudulent acts of the Insured/ Insured Beneficiary(ies) and/or Insuredâs/Insured Beneficiary(ies) family and/or Insuredâs/ Insured Beneficiary(ies) employees.
17. Failure of parts that are subject to recall by the manufacturer of the Insured Asset.
18. The cost of repairing, restoring or reconfiguring computer software or any system programs.
19. Loss or damage due to corrosion, rust, denting, scratching, blockages or dust.
20. Loss or damage due to use of non-genuine parts, accessories and/or consumables.
21. Service/maintenance calls that do not involve malfunction or defects in the Insured Asset due to workmanship or material used by the manufacturer.
22. Ionising, radiation or contamination by radioactivity from any nuclear fuel or any nuclear waste or the combustion of nuclear fuel.
23. War, invasion, acts of foreign enemies, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation or nationalisation or requisition of or damage to property by or under the order of any government or public local authority.
24. Any loss or damage occurring when the Certificate of Insurance is not in force for any reason.
25. Claims series clause â Any claims series shall not be covered by the extended warranty policy. A claims series event is defined as follows
a. Several equal or similar claims due to the same cause, e.g. the same fault, negligent act, error or omission in design or supervision and/or
b. an event or circumstance leading to a recall of products or works or parts thereof.
c. Any part or circumstance not covered by the original manufacturerâs guarantee
d. Negligence, error or omission in design
e. Damage due to improper maintenance, willful or gross negligence

5. General Terms
1. Coverage commences upon the expiration of the OEMâs Limited Warranty.
2. Coverage is limited to new products only, excluding accessories.
3. Territorial Scope: India
4. The maximum claim amount shall not exceed the original purchase price of the product. For multiple claims, the sum insured will be the productâs residual value.
5. All repairs are to be carried out at authorized/ Zopper partner service centres within India only.
6. Claims must be reported/registered within 14 days of the equipmentâs malfunction.
7. Cost of labor & components to be covered.
8. A claim will only be considered if accompanied by a legible IMEI or serial number.
9. Zopper will facilitate repairs for claims made during the in-warranty period.
10. Cashless: The program is completely cashless and serviced by Zopper. This Plan is offered and valid only if you are making a purchase in India and using it in India.
11. In carrying out its obligations, the Parties may, at their discretion and solely to monitor the quality of their response, record part or all of the calls.
12. Zopper has adequate security measures to protect customerâs data against unauthorised access or disclosure as well as unlawful destruction. Zopper will be responsible for carrying out the instructions that the customer gives to Zopper regarding the processing of data, and Zopper will comply with those instructions as reasonably necessary solely for the performance of the service and support obligations under the Plan and Zopper acknowledges and confirms that the customer data will not be used for any other purpose, whatsoever.
13. The Parties are not obligated to renew this Plan.
14. In the event any section or portion of a section of these terms and conditions are deemed invalid, void or unenforceable, that section or portion of a section shall be severed from these terms and conditions, and the remaining terms and conditions shall continue in full force and effect.
15. These terms and conditions shall be governed by and construed under the laws of India.
16. These terms and conditions do not affect your statutory rights as a consumer.
17. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAYTM, ZOPPER AND ITS EMPLOYEES AND AGENTS WILL UNDER NO CIRCUMSTANCES BE LIABLE TO YOU OR ANY SUBSEQUENT OWNER FOR ANY INDIRECT OR CONSEQUENTIAL DEFECTS OR
18. ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICES, WHETHER FORESEEABLE OR UNFORESEEABLE, AND WHETHER BASED ON, BREACH OF CONTRACT, STRICT LIABILITY IN TORT, ANY LOSS OF BUSINESS, PROFITS, REVENUE OR ANTICIPATED SAVINGS, RESULTING FROM ZOPPERâS OBLIGATIONS UNDER THIS PLAN. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LIMIT OF ZOPPER AND ITS EMPLOYEES AND AGENTâS LIABILITY TO YOU AND ANY SUBSEQUENT OWNER ARISING UNDER THE PLAN SHALL NOT EXCEED THE VALUE OF THE PRODUCT. ZOPPER SPECIFICALLY DOES NOT WARRANT THAT (i) IT WILL BE ABLE TO REPAIR OR REPLACE REGISTERED PRODUCT WITHOUT RISK TO OR LOSS OF PROGRAMS OR DATA, (ii) THAT THE OPERATION OF THE PRODUCT WILL BE UNINTERRUPTED OR ERROR-FREE.

7. CLAIMS:
1. Excludes â Battery, and issues related to accidental damage.
2. In-warranty Repair/Replacement as a service (pick up and drop) â this is for customers wherein the Manufacturer's Warranty hasnât expired.
3. Total payout will be restricted to the maximum sum insured or 50% of the phone's original invoice value (whichever is lower).
4. Any amount in excess of the Total payout must be borne by the customer.
5. One claim per phone for a 12-month cycle.
8. CANCELLATION AND REFUND
If the product is cancelled within 3 days from the date of purchase, 100% of the plan amount will be refunded. Cancellations are not allowed after 3 days from the date of purchase.
